Welcome to Top Photos. By using our app, you agree to these Terms of Service. Please read them carefully.

1. About Our Service

Top Photos is an AI-powered portrait generation service. You upload photos of yourself, and our AI creates stylised portrait images based on various themes and packages.

2. Eligibility

You must be at least 16 years old to use Top Photos. By using our service, you confirm that you meet this requirement.

3. Account Registration

• You may register using email/password, Google Sign-In, or Apple Sign-In
• You are responsible for maintaining the security of your account
• You must provide accurate information when creating your account
• One person may only maintain one account

4. Acceptable Use

When using Top Photos, you agree NOT to:

• Upload photos of other people without their consent
• Upload photos of minors
• Upload inappropriate, offensive, or illegal content
• Use the service for any unlawful purpose
• Attempt to reverse-engineer or exploit our AI systems
• Resell or commercially redistribute generated images without permission
• Use generated images to deceive, defraud, or mislead others

5. Photo Upload Requirements

For best results and to comply with our policies:

• Only upload photos of yourself
• Ensure photos are clear and well-lit
• Do not upload photos containing nudity or explicit content
• You retain ownership of photos you upload

6. Payments and Refunds

Pricing

• Package prices are displayed in the app before purchase
• All prices are in British Pounds (GBP) unless otherwise stated
• Prices may change without notice; purchases are locked at the price shown at checkout

Refunds

• Due to the nature of AI-generated content, refunds are generally not provided once image generation has begun
• If our service fails to deliver your images due to a technical error on our part, you may request a full refund
• Refund requests must be made within 14 days of purchase

7. Intellectual Property

Your Content

You retain ownership of photos you upload. By uploading, you grant us a limited licence to process your photos for the purpose of generating portraits.

Generated Images

Once you purchase a package, you receive a personal, non-exclusive licence to use the generated images for:

• Personal use (social media, profile pictures, etc.)
• Non-commercial purposes

For commercial use of generated images, please contact us for a commercial licence.

Our Property

The Top Photos app, AI models, branding, and service infrastructure remain our exclusive property.

8. Service Availability

• We aim to provide reliable service but do not guarantee 100% uptime
• Image generation typically completes within minutes but may take longer during peak times
• We reserve the right to modify or discontinue features with reasonable notice

9. Limitation of Liability

To the maximum extent permitted by law:

• Our service is provided "as is" without warranties
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid for the service
• We are not responsible for how you use generated images

10. Content Moderation

We reserve the right to:

• Refuse to process photos that violate our policies
• Remove or disable access to content that violates these terms
• Suspend or terminate accounts that repeatedly violate our policies

11. Account Termination

You may delete your account at any time by contacting support. We may terminate accounts that violate these terms. Upon termination:

• Your access to the service will cease
• Your uploaded photos and generated images will be deleted
• No refunds will be provided for unused portions of purchases

12. Changes to Terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the new terms. We will notify you of significant changes via email or in-app notification.

13. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.
